The following Terms of Use ("Terms") are a legal agreement between you ("User") and ArchEducate LLC ("we", "us", "our"), which governs your access to and use of our products and services obtained through our website and any related domains or subdomains (collectively, the "Site"). By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Site.

Definitions

  • "Products" include but are not limited to: educational materials, courses, videos, audio, articles, books (electronic and physical), and any other resources offered on the Site, whether paid or provided for free. All Products are the intellectual property of ArchEducate LLC.

Use of the Site: By using the Site and the Products offered, you agree to comply with these Terms.

Intellectual Property Rights: The content on the Site, including all Products, is owned by ArchEducate LLC or its licensors and is protected by copyright and other intellectual property laws. We grant you a non-exclusive, non-transferable license to access and use the Products for your personal, non-commercial purposes, subject to these Terms.

All content provided on the Site, including but not limited to text, graphics, logos, images, course material, video content, and all other intellectual property, is the property of ArchEducate LLC or its content suppliers and protected by United States and international copyright laws. The compilation of all content on this Site is the exclusive property of ArchEducate LLC and protected by U.S. and international copyright laws.

Copyright License

ArchEducate LLC grants the purchaser a limited, non-exclusive, non-transferable license to access, non-commercial use of the Site and the Products. This license does not include any resale or commercial use of any Product, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Product or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms or any Service Agreement are reserved and retained by ArchEducate LLC or its licensors, suppliers, publishers, rights holders, or other content providers. No Product, nor any part of any Product, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of ArchEducate LLC. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of ArchEducate LLC without express written consent.

Unauthorized Use and Infringement Penalties

If you violate any of the Terms of Use, including unauthorized use of the content, products, or services provided by ArchEducate LLC, you may be subject to enforcement actions including, but not limited to, being charged for a lifetime license fee and/or legal action.

In cases of unauthorized use or infringement of our intellectual property, ArchEducate LLC reserves the right to impose a penalty by charging an infringement fee. This fee is intended to compensate for the unauthorized use of our copyrighted material and will be assessed at the discretion of ArchEducate LLC. The infringement fee is set at a flat rate equivalent to the cost of a lifetime license for the infringed product(s) or service(s), as determined by ArchEducate LLC.

Legal Action

ArchEducate LLC reserves the right to pursue legal action to the fullest extent permitted by law against any user who infringes the intellectual property rights of ArchEducate LLC or violates the terms of this agreement. Legal remedies may include, but are not limited to, seeking damages for loss of revenue, obtaining injunctive relief to prevent further misuse of our intellectual property, and recovery of legal fees incurred in pursuing such actions.

Compliance and Cooperation

Users are encouraged to respect the intellectual property rights of ArchEducate LLC and to contact us immediately if they become aware of any unauthorized use of the products, services, or content provided through our Site. ArchEducate LLC is committed to ensuring a fair and lawful use of its intellectual property and appreciates the cooperation of its users in upholding these principles.

Prohibited Uses: You may not use the Site or Products for any illegal or unauthorized purpose. You agree not to reproduce, duplicate, copy, sell, or resell, any portion of the Site or Products.

Limitation of Liability: ArchEducate LLC will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Site or Products.

Changes to Terms: We reserve the right to modify these Terms at any time. We will post the revised Terms on the Site, and they will become effective immediately upon posting. Your continued use of the Site after any changes to these Terms will constitute your acceptance of such changes.

Subscription and Purchase

When you subscribe to or purchase a product from ArchEducate LLC that includes a trial period, you are considered a customer of ArchEducate LLC from the moment of initiation of the trial. By starting your subscription and entering your payment information, you agree to the specific duration of the trial period and the commencement of billing after the trial period ends, as clearly indicated on the checkout page.

Trial Period

Our products may come with a trial period that allows you to experience the product free of charge for a limited time, as specified at the time of purchase. The duration of the trial period will be visible on the checkout page when you subscribe or purchase the product. Unless you cancel before the end of the trial period, you agree that we may automatically start to charge you for the subscription on the first day following the end of the trial, on a recurring monthly or annual basis according to the subscription plan chosen by you. Your payment details will be charged the applicable subscription fee for your chosen plan.

Cancellation Policy

You have the right to cancel your subscription at any time. If you decide to cancel your subscription during the trial period, you will not be charged. If you cancel after the trial period has ended and after your subscription has begun, you will have access to your subscription until the end of the current billing cycle. You will not be billed for the next billing cycle after cancellation. No refunds or credits for partial subscription periods will be provided.

Please note that the cancellation of a trial or subscription must be done at least 24 hours before the trial or subscription period ends to avoid being charged for the next billing cycle.

Changes to Subscription Plans

ArchEducate LLC reserves the right to modify, terminate, or otherwise amend our offered subscription plans and trial terms at any time in accordance with these Terms. Such changes will not affect any trial period or subscription already paid for unless otherwise stated in the terms of the subscription or trial offer.

ARE Pass Guarantee : Premium Membership

Eligibility and Conditions

This ARE Pass Guarantee ("Guarantee") is designed to support candidates preparing for the Architect Registration Examination® (ARE®). Eligibility for this Guarantee is contingent upon the candidate meeting the following conditions:

  1. Membership Requirement: The candidate must maintain an active Premium membership ("Membership") throughout the duration of their exam preparation and testing period.

  2. Completion of Recommended Coursework: The candidate must complete all recommended course lessons, lectures, quizzes, and practice exams ("Coursework") as tracked and recorded by our system. Failure to complete the Coursework in its entirety disqualifies the candidate from reimbursement under this Guarantee.

  3. Reporting Compliance: It is mandatory for the candidate to report all ARE exam outcomes—both passes and fails—as well as the dates of each exam attempt, accurately and promptly by emailing [email protected] with the subject line : "Last Name - Premium Membership".

  4. Claim Submission Window: A reimbursement claim under this Guarantee must be submitted within thirty (30) days following the date of a failed ARE division exam ("Claim Period"). Claims submitted after the expiration of the Claim Period will not be considered.

  5. Proof of Failure Documentation: To validate a reimbursement claim, the candidate must provide a copy of the NCARB ARE® Score Report as proof of the failed exam within the Claim Period. Incomplete or missing documentation will result in denial of the claim.

By enrolling and participating in this Guarantee, candidates agree to adhere to these terms. Our team reserves the right to monitor and verify the completion of the Coursework for each account. This Guarantee is subject to changes or termination at any time, without prior notice, at the sole discretion of ArchEducate LLC.
